NewsFailures (“we,” “us,” or “our”) operates the website and platform at newsfailures.com. We provide data analytics, signal detection, and informational tools related to economic event releases and commodity futures markets. We are not a registered investment adviser, broker-dealer, or financial planner.
You must be at least 18 years old and capable of entering a binding contract to use our service. By using NewsFailures, you represent that you meet these requirements. We reserve the right to refuse service to anyone at our discretion.
You are responsible for maintaining the confidentiality of your login credentials. You may not share your account with others or use another person’s account without permission. You are responsible for all activity that occurs under your account. Notify us immediately at admin@newsfailures.com if you suspect unauthorized access.
Free Trial. New users may access the platform for 14 days at no charge. A credit card is required to start a trial. At the end of the trial period, continued access requires a paid subscription.
Paid Subscription. Our Professional plan is billed monthly at the stated rate at the time of purchase. Prices are subject to change with 30 days’ notice.
Cancellation. You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. We do not issue partial refunds for unused time unless required by applicable law.
Refunds. We do not offer refunds except where required by law. If you believe a charge was made in error, contact us within 30 days at admin@newsfailures.com.

All content on NewsFailures — including signal methodology, data analysis, platform design, and text — is owned by or licensed to us and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access the platform for your personal, non-commercial use only.
NewsFailures provides analytics and informational tools only. Nothing on this platform constitutes investment advice, a recommendation to buy or sell any security or futures contract, or a solicitation of any investment. All trading involves substantial risk. Past signal performance does not guarantee future results. You are solely responsible for your own trading decisions. See our Risk Disclosure for more detail.
The platform is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or that data will be accurate or complete. To the maximum extent permitted by law, we disclaim all warranties including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by applicable law, NewsFailures and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or trading losses, arising from your use of or inability to use the platform, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising from these terms shall not exceed the amount you paid us in the 12 months preceding the claim.
You agree to indemnify and hold harmless NewsFailures and its owners, officers, and employees from any claims, damages, losses, or expenses (including legal fees) arising from your use of the platform, your violation of these Terms, or your violation of any applicable law.
Our platform incorporates data from third-party sources including government agencies (USDA, EIA, BLS) and market data providers. We do not guarantee the accuracy or timeliness of third-party data. We are not responsible for errors, delays, or omissions in third-party data.
We reserve the right to modify, suspend, or discontinue any part of the platform at any time with or without notice. We will make reasonable efforts to notify active subscribers of material changes.
We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any conduct we determine to be harmful to other users or to us. Upon termination, your right to access the platform ceases immediately. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will survive.
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Palm Beach County, Florida.
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the platform. Continued use of the platform after changes take effect constitutes acceptance of the updated Terms.
